KontraS Urges Murder Investigation Arlince Tabuni By TNI Member in Papua

PAPUAN, Jakarta - The Commission for Missing Persons and Victims of Violence (KontraS) urged investigation into the murder Arlince Tabuni, 11-year-old children by members of the TNI in Popume village, Mukoni District, Lanny Jaya regency, Papua, on July 1, 2013 last.

"We deplore the violence still continues in Papua. Among them, we have the shooting information of a child, aged 11 (eleven) years on behalf Arliance Tabuni, "said Yati Andriani, one of the staff KontraS, in a press release sent to the media editors, this afternoon.
 

It said the incident occurred on July 1, 2013, around 17:30, in Popume village, Mukoni District, Lani Jaya regency, Papua, Indonesia at around 17:30 Eastern Time (Wit).

The event begins with a shot was fired by members of the Indonesian Armed Forces (TNI) and National Police (INP) which is directed against the people who were in police action Tiom on July 01, 2013, at 14.00 Wit.

Furthermore, in the afternoon at 17.30 Wit in Popume village, Mukoni District, Lani Jaya regency came a vehicle carrying members of the military about 4 people, armed with the complete call and ask one of the people "in this Balingga there are hordes / OPM where?" Answered by the people "I am a signature for the expansion of the district's Triple Command in Chief of me, and we also keep the red and white flag that you love and the biblical book till date".

After getting this information, members of the military dropped down, and shortly thereafter hear gunshots, some residents toward the sound of gunfire, and saw Arliance Tabuni (victim) is dead from a gunshot wound to the chest.

Against such events, KontraS see, first, there is no justification whatsoever for the actions of the above military members, considering the victim is a child, and was not armed or armed parties.

"The actions above shows the lack of professionalism and brutality of the security forces in conducting security operations," said Andriani.

Second, in conducting security operations in Papua, the security forces did not pay attention to the principle - the principle of human rights, as stipulated in Regulation No. 73/IX/2010 TNI Commander of Opposition to Torture and Other Cruel Environmental Law Enforcement in the Indonesian National Army .

Third, there has been a violation of human rights in the form of loss of life of a child under age. Where is the right to life can not be reduced under any circumstances (Non-derogable rights), as stipulated in Law no. 39 of 1999 on Human Rights, Article 9, paragraph (2) "Everyone has the right to live peaceful, safe, peaceful, happy, prosperous, spiritual and physical."

Fourth, there has been a crime of murder and persecution, as mentioned Article 338 of the Law - Criminal Code (Criminal Code) "Anyone who intentionally depriving another person's life, is liable for murder by a maximum imprisonment of fifteen years".

Fifth, there has been a criminal offense in the form of abuse and violence against children as stipulated in Law no. 23 of 2002 on Child Protection, Article 80 paragraph (1) "Every person who committed atrocities, violence or threats of violence, or child abuse, shall be punished with imprisonment of three (3) years and 6 (six) months and / or fines maximum of Rp 72,000,000.00 (seventy-two million dollars) ".

Related events, KontraS also urged, first, Papua Police to immediately conduct an investigation related to the actions of members of the military who have committed criminal acts such as murder generally above.

Second, the TNI (Denpom Biak) immediately coordinate with the police and handed over the murder case to the police to be processed through the mechanism of public justice.

And third, the National Human Rights Commission to immediately conduct an investigation and field monitoring as soon as possible, in order to find independent facts in this case, as well as ensuring a fair and legal responses transparent from the local police and the military.

The TNI and the police so far denied the shooting of Arlince Tabuni , and have sparked an armed group in the region.
